1. Acceptance of Terms

By accessing and using AryaStay ("the Platform"), you accept and agree to be bound by the terms and provisions of this agreement. If you do not agree to abide by these terms, please do not use this service.

2. Description of Service

AryaStay provides an online platform that connects hosts who have accommodations to rent with guests seeking to book such accommodations. The Platform allows hosts to list their properties and guests to search for and book accommodations.

3. User Accounts

To use certain features of the Platform, you must:

  • Be at least 18 years of age
  • Create an account with accurate and complete information
  • Maintain the security of your account credentials
  • Promptly update any changes to your account information
  • Accept responsibility for all activities under your account

4. Host Responsibilities

As a host, you agree to:

  • Provide accurate and complete information about your property
  • Maintain your property in a safe and habitable condition
  • Comply with all applicable laws and regulations
  • Honor confirmed bookings and provide the advertised accommodations
  • Respond promptly to guest inquiries and booking requests
  • Maintain appropriate insurance coverage for your property
  • Pay all applicable taxes and fees

5. Guest Responsibilities

As a guest, you agree to:

  • Provide accurate booking information
  • Treat the property with respect and care
  • Follow house rules set by the host
  • Leave the property in the condition you found it
  • Report any damages or issues promptly
  • Not exceed the maximum number of guests
  • Comply with local laws and regulations

6. Booking and Payments

The following terms apply to bookings:

  • All bookings are subject to host acceptance
  • Payment is processed through our secure payment system
  • Guests are charged at the time of booking confirmation
  • Hosts receive payment after guest check-in
  • Service fees apply to both hosts and guests
  • Cancellation policies vary by listing

7. Cancellation Policy

Cancellation terms depend on the policy set by the host:

  • Flexible: Full refund up to 24 hours before check-in
  • Moderate: Full refund up to 5 days before check-in
  • Strict: 50% refund up to 7 days before check-in
  • Non-refundable: No refund after booking

Service fees may be refundable depending on the cancellation timing and policy.

8. Service Fees

AryaStay charges the following fees:

  • Guest Service Fee: Typically 14% of the booking subtotal
  • Host Service Fee: Typically 3% of the booking subtotal

Fees may vary based on the booking and are clearly displayed before confirmation.

9. Prohibited Activities

Users are prohibited from:

  • Posting false, misleading, or fraudulent content
  • Discriminating against any person based on protected characteristics
  • Using the Platform for illegal activities
  • Harassing, threatening, or abusing other users
  • Attempting to circumvent the Platform's payment system
  • Scraping or copying content without permission
  • Creating multiple accounts to manipulate reviews or ratings

10. Content and Intellectual Property

All content on the Platform, including text, graphics, logos, and software, is the property of AryaStay or its licensors and is protected by copyright and other intellectual property laws. Users retain ownership of content they post but grant AryaStay a license to use, display, and distribute such content.

11. Reviews and Ratings

Our review system operates as follows:

  • Both hosts and guests can leave reviews after a stay
  • Reviews must be honest, accurate, and based on personal experience
  • Reviews are published after both parties submit or 14 days pass
  • AryaStay may remove reviews that violate our content policy
  • Users cannot edit reviews after submission

12. Dispute Resolution

In the event of a dispute between hosts and guests, AryaStay may assist in resolution but is not obligated to do so. Users agree to first attempt to resolve disputes directly. If resolution cannot be reached, disputes may be escalated to AryaStay's support team.

13. Limitation of Liability

AryaStay acts as an intermediary platform and is not responsible for the conduct of hosts or guests. We do not own, create, sell, or manage any listings. To the maximum extent permitted by law, AryaStay shall not be liable for any indirect, incidental, special, or consequential damages.

14. Indemnification

You agree to indemnify and hold harmless AryaStay, its affiliates, and their respective officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses arising from your use of the Platform or violation of these Terms.

15. Termination

AryaStay may terminate or suspend your account and access to the Platform immediately, without prior notice, for any reason, including if you breach these Terms. Upon termination, your right to use the Platform will immediately cease.

16. Governing Law

These Terms are governed by and construed in accordance with the laws of India. You irrevocably submit to the exclusive jurisdiction of the courts located in Surat, Gujarat, India.

17. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify users of material changes via email or through the Platform. Continued use of the Platform after changes constitutes acceptance of the modified Terms.
